Version 1.0, effective from 2026-10-06. This English text is a convenience translation; the Polish version prevails.
1. Definitions
Service Provider - Flowbity sp. z o.o., registered office at os. Jana III Sobieskiego 40/2N, 60-688 Poznań, Poland, entered in the register of entrepreneurs kept by the Sąd Rejonowy Poznań - Nowe Miasto i Wilda w Poznaniu, VIII Wydział Gospodarczy Krajowego Rejestru Sądowego (District Court Poznań - Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register) under KRS 0001225616; VAT ID (NIP) 9721376119, REGON 544047871, share capital PLN 5,000.00, operating the service at https://servavio.com. Contact: admin@flowbity.com.
Service - the "Servavio" web application supporting the sale of car parts on marketplaces: recognising parts and reading numbers from photos, proposing categories, parameters, matching vehicles and descriptions, publishing offers and keeping their state in sync.
User - an entrepreneur within the meaning of Article 431 of the Polish Civil Code who has concluded a contract for the Service with the Service Provider.
Account - the User's resources in the Service, available after signing in. A company Account may have several users: administrators and employees invited by an administrator.
Marketplace - an external sales platform the Service connects to. On the effective date of this version this is Allegro. Ovoko support is planned and will be announced in the Service.
Plan - the set of limits assigned to the Account (offers, users, part recognitions and AI descriptions per month), shown in the User's panel.
AI Content - everything the Service proposes automatically: part numbers read from photos, the recognised part type, category, parameters, the list of matching vehicles, the offer title and description.
2. Nature of the service
The Service is provided to businesses only (B2B). By registering an Account the User declares that the contract is directly related to its business activity and is of a professional nature for it. Consumer-protection rules do not apply.
The Service Provider is not a party to sales contracts between the User and buyers, nor to the User's contracts with Marketplaces. The Service Provider is not affiliated with Allegro or Ovoko.
The contract is concluded in Polish. In case of discrepancies the Polish version of these Terms prevails.
3. Conclusion of the contract and the Account
The contract is concluded when the Account is created, after ticking the box at registration that confirms acceptance of these Terms and of the Data Processing Agreement and that the Privacy Policy has been read. Using the Account requires a confirmed e-mail address.
The Service Provider records the version of the accepted documents, the date of acceptance and the IP address.
The person registering the Account declares that they are authorised to represent the User. The Account administrator is responsible for whom they grant access to and for the actions of invited persons.
An invited employee accepts these Terms and reads the Privacy Policy before first using the Account.
The User protects its sign-in data and promptly reports any suspected unauthorised access.
The Service Provider may refuse to conclude the contract or suspend the Account where the User's data is untrue or in the case described in §8(4).
4. Technical requirements
Internet access and a current browser (Chrome, Edge, Firefox or Safari in a version supported by its vendor).
The User's own business account on the Marketplace, entitled to list offers. A private Allegro account cannot be used to list offers through the Service.
Photos in JPG or PNG format.
5. Fees
Pilot period. On the effective date of this version the Service is provided free of charge, within the limits of the Plan assigned to the Account. The Service Provider may change Plan limits with 14 days' notice.
Paid plans and individual terms. Higher limits or additional services are provided on the basis of individual arrangements with the User (net price, billing period, limits), confirmed by e-mail. Individual arrangements, including the "Founding 10" programme terms, prevail over these Terms.
Fees are settled on the basis of a VAT invoice payable by bank transfer within the term stated on it. Invoices are issued in the Fakturownia service and submitted to the Polish National e-Invoicing System (KSeF) as required by law. VAT is added to net prices.
The User provides true and current invoicing data (name, address, tax ID).
A payment delay of more than 14 days entitles the Service Provider, after a prior e-mail reminder, to pause publishing new offers, part recognition and description generation until payment.
Online payments (card, automatic subscription renewal, trial period, price list) are not available at present. Their rules are set out in Annex 1, which takes effect only once they are launched, announced to Users at least 14 days in advance. Free use of the Service will not turn into paid use without the User's explicit choice.
6. AI Content and the duty to verify
AI Content is produced automatically, using language models and external data sources. It may be wrong or incomplete: a number may be misread from a label, the list of matching vehicles may include a vehicle the part does not fit or omit one it does, and a category, parameter or description may not correspond to the part.
AI Content is a proposal. Before publishing, the User checks every offer: part numbers, condition, category, parameters, vehicle list, title, description, photos and price. Publishing an offer, or approving it in companies that use offer approval, means the User has adopted its content as its own and true.
Choosing a product from the Allegro catalogue means that part of the offer data (including the producer and catalogue number, and catalogue photos) comes from that product. The User checks that the chosen product corresponds to the part being sold; the Service warns about mismatched numbers, but the warning does not replace that check.
Towards buyers, Marketplaces and authorities, the User alone is responsible for the content of offers, conformity of the goods with the offer, statutory warranty and guarantee, returns, complaints, information required by law (including product-safety data) and the tax settlement of sales.
The Service Provider does not guarantee that AI Content will be correct, that an offer will be accepted by the Marketplace or that a sale will take place.
7. Acting on the User's Marketplace account
By connecting a Marketplace account to the Service, the User authorises the Service Provider to perform on its behalf, through the Marketplace's programming interface and within the consents granted when connecting the account, the following: creating, publishing, changing, ending, resuming and relisting offers; uploading photos; linking offers to products in the Marketplace catalogue; assigning the return, complaint and warranty terms and the product-safety data indicated by the User; reading offers, their state and sales settings.
These actions are performed on the User's instruction given in the Service or automatically, according to the User's settings (for example how a sold or ended offer is relisted) and to keep offer state consistent.
The authorisation ends when the Marketplace account is disconnected in the Service settings or the consent is withdrawn on the Marketplace side. Offers listed earlier stay on the Marketplace and are no longer synchronised.
Marketplace fees and commissions related to offers (including listing, promotion, relisting and sale fees) are borne by the User, also where an action was performed automatically according to its settings.
The User complies with the Marketplace's rules. The consequences of the Marketplace's decisions regarding the User's account or offers (rejection or removal of an offer, restriction or suspension of the account) are borne by the User, unless they result solely from an error of the Service; in that case §9 applies.
The Service Provider does not handle buyers' orders or payments and has no access to their data.
8. User obligations, shared access to the Marketplace
The User uses the Service in accordance with the law, these Terms and the Marketplace's rules. In particular it does not list goods whose sale is prohibited, does not enter content infringing third-party rights (including copyright and trade mark rights) and does not give untrue information about the goods.
The User enters into the Service only photos and content it has rights to. Photos of parts should not show people, licence plates or documents with personal data.
The User does not circumvent Plan limits or the Service's safeguards, does not create several Accounts for the same entity to bypass limits and does not use the Service by automated means outside its interface.
The Service connects to the Marketplace as a single application registered by the Service Provider, shared by all Users. A breach of Marketplace rules by one User may lead to that application being restricted or blocked for everyone. The Service Provider may therefore immediately pause publishing from an Account or suspend it where the User breaches the law, these Terms or the Marketplace's rules, where the Marketplace raises objections to its offers, or where its actions endanger the Service's access to the Marketplace. The Service Provider informs the User of the suspension and its reason by e-mail.
The User indemnifies the Service Provider against third-party, Marketplace and authority claims, penalties and costs arising from the content of the User's offers, from the goods it sells and from its breach of the law, these Terms or the Marketplace's rules, and reimburses the Service Provider's reasonable, documented costs incurred on that account, including damage resulting from the blocking of the application referred to in §8(4).
The User keeps the rights to its content. It grants the Service Provider a non-exclusive licence to use it to the extent needed to provide the Service (storing, processing, sending to the Marketplace and to the providers named in the Privacy Policy). The Service Provider may use technical information about parts that contains neither personal data nor the User's data (for example the link between a part number and vehicles) to run and improve the Service for all Users.
9. Liability of the Service Provider
The Service Provider provides the Service with due care, as it is made available. It does not guarantee uninterrupted operation; it may carry out technical work, of which it gives notice where possible.
The Service Provider's total liability towards the User under and in connection with the contract, whatever the legal basis, is limited to the sum of net fees paid by the User for the Service in the 6 months preceding the event causing the damage, but not less than PLN 500.
The Service Provider is liable for actual loss only. It is not liable for lost profits, loss of revenue, customers, reputation or the standing of an account on the Marketplace.
In particular, the Service Provider is not liable for:
the consequences of publishing an offer the User did not check as required by §6, including wrong AI Content;
buyers' claims, returns, complaints and disputes concerning goods sold;
the Marketplace's fees, commissions, penalties and decisions, its outages, and changes to its interface, rules or catalogue;
outages and errors of external providers (including AI models, e-mail and hosting) and force majeure;
the consequences of the User sharing sign-in data with third parties.
The limitations in this section do not apply to damage caused intentionally, nor to the extent mandatory law does not allow them.
Liability under statutory warranty for defects of the Service is excluded.
10. Complaints
Complaints about the Service should be sent to admin@flowbity.com, with a description of the problem and the Account's e-mail address. The Service Provider replies within 14 business days of receipt.
11. Termination and Account deletion
The User may terminate the contract at any time, without giving a reason, by deleting the Account in the Service settings (Account administrator) or by writing to admin@flowbity.com.
The Service Provider may terminate the contract with 30 days' notice, and with immediate effect in the event of a material breach of these Terms, the law or the Marketplace's rules, or a payment delay of more than 30 days.
Before deleting the Account the User may download its data in the Service settings ("Export data").
On deletion of the Account: sign-in is blocked, the Marketplace account is disconnected and any subscription paid online is cancelled. Offers published on the Marketplace stay active; the Service stops synchronising them and the User manages them directly on the Marketplace.
For 30 days after deletion the Service Provider can restore the Account at the User's request sent by e-mail. After that the Account data (parts, photos, offers, settings, user accounts) is permanently deleted. In backups the data expires by rotation, after 12 months at the latest. Accounting documents are kept for the period required by law. Details are in the Privacy Policy.
Fees for a billing period already started are not refunded, unless the contract is terminated by the Service Provider without the User's fault; in that case it refunds the fee in proportion to the unused period.
12. Changes to the Terms
The Service Provider may change these Terms for important reasons: a change in the law, a change in the scope or operation of the Service, a change in the rules of the Marketplace or of providers, security reasons, the launch of online payments.
Each version of the Terms has a number and an effective date. The Service Provider gives notice of a change by e-mail or by a message in the Service at least 14 days in advance. The Service asks for acceptance of the new version at sign-in.
A User who does not accept the change may terminate the contract under §11 before it takes effect. Earlier versions of the Terms are available from the Service Provider on request.
13. Final provisions
Governing law: the law of Poland.
Disputes are resolved by the court having jurisdiction over the Service Provider's registered office.
The invalidity of one provision does not affect the validity of the others.
This annex takes effect once online payments are launched, announced as described in §5(6). Until then it is for information only.
Online payments are handled by Stripe. Card data is entered on Stripe's page; the Service Provider does not receive it.
The price list of plans, with net prices and the VAT amount, will be shown in the User's panel before a plan is chosen and will become part of this annex.
A subscription renews automatically for the next billing period until the User cancels it in the panel. After cancellation the plan stays active until the end of the paid period.
Where a plan includes a trial period, its length, price and the plan it converts to are shown before it starts. A trial can be cancelled before it ends at no further charge.
After a failed payment the Service Provider informs the User by e-mail; until the amount due is settled it may pause publishing new offers, part recognition and description generation.
